Paying a UAE loan from India, the UK or the Philippines — the routes, and whether the bank can reach you there

You can pay a UAE loan from India, the UK or the Philippines. Three routes carry the money: your own UAE account, kept open and topped up by transfer so the standing instruction keeps paying; a direct transfer to the settlement account the bank names once you have a settlement letter; or a person you authorise in the UAE paying in for you. The legal position differs by country: India has executed UAE court judgments since 17 January 2020, while for the UK and the Philippines we found no equivalent, so a bank there would need a fresh local action. Agree the terms in writing first, pay only against a letter, and keep every receipt.

First, the figure and the letter

Money sent to a bank without an agreement is credited to an account that is still accruing interest and fees on the original schedule, and a bank that has not heard from you continues to treat the file as a default. So the first step is not a transfer.

  1. Ask for a liability letter or a statement. The bank must issue one within 7 working days under the Central Bank's rules; the liability-letter guide explains what it is and what it may cost.
  2. Write to the remediation team with where you are, what you can pay and over what period. Emirates NBD's Debt Assist page describes its Financial Remediation team and says that once an agreement is reached the bank issues a settlement letter and the customer deposits the agreed amount into an account the bank names, with the IBAN published on the page. Other banks run the same process under different names; the bank pages carry their hardship contacts.
  3. Pay only against the letter. The letter fixes the figure and the dates. Early or final settlement fees are capped at 1 percent of the outstanding balance or AED 10,000, whichever is less. The three routes for the money

Transfers from India, the UK and the Philippines into a UAE IBAN are ordinary remittances in the other direction; the cost is the exchange-house or bank fee and the rate on the day, which is the reader's own figure.

India: a UAE judgment can be executed

On 17 January 2020 India's Ministry of Law and Justice issued a gazette notification declaring the United Arab Emirates a reciprocating territory under section 44A of the Code of Civil Procedure, 1908, and naming as superior courts the Abu Dhabi Judicial Department, the Dubai Courts, the Ras Al Khaimah Judicial Department and the federal first-instance and appeal courts in Abu Dhabi, Sharjah, Ajman, Umm Al Quwain and Fujairah. Under section 44A, a certified copy of a decree from those courts can be filed in an Indian district court and executed as if the district court had passed it.

What that means in practice:

  • a bank with a UAE judgment against you does not need to sue again in India; it files the decree for execution;
  • a bank without a judgment has a collection agency, and the agency can contact you but cannot compel payment;
  • the arithmetic that favours settling from abroad is the same as at home: the bank prefers a sum it can see to a process it must run.

The UK and the Philippines: contact, not compulsion

We could find no arrangement for either country equivalent to India's. A UAE civil judgment is not registered for direct execution; a bank wanting to compel payment there would need to bring a fresh action in the local courts on the underlying debt, and whether it does is a matter of the amount against the cost.

What does happen is contact. Banks appoint collection agencies abroad; Emirates NBD publishes the list of debt-service partners it authorises. A caller who cannot be matched to the bank's own list is not collecting for the bank, and the collectors guide sets out what any collector may and may not say. None of this makes the debt go away. The claim, any judgment and any travel ban stay in their registers until they are resolved, which matters the day you want to come back.

Keeping the record

Everything in this process is paper: the liability letter, the settlement letter, every transfer confirmation, every email. Keep them in one folder that is not only on your phone. On the last payment, ask for the clearance letter the same day; the bank has 7 working days to issue it, and it is the document that ends the matter.

Frequently asked questions

Should I keep paying the original instalments or wait for a settlement?

Keep paying what you can while you negotiate; every payment reduces the figure and shows the file is alive. But do not assume a payment changes the terms. Only the letter does that.

Can I settle for less than the balance from abroad?

Banks consider it, case by case, and no percentage is published. The offer calculator shows what a lump sum is as a share of the balance and drafts the letter; the bank's answer is the bank's.

The bank's collector in India says I will be arrested. Is that true?

No. An unpaid loan is a civil matter in the UAE, and a collection agency in India has no power of arrest anywhere. What a bank with a judgment can do in India is file it for execution against assets. Ask the caller for the bank's authorisation and verify it against the bank's list.

What if my UAE account was closed and the standing instruction stopped?

Does paying from abroad protect my AECB file?
